(The IST News);- A meeting between the hon’ble PM Narendra Modi, the Leader of Opposition Rahul Gandhi and Home Minister Amit Shah, is scheduled to take place tomorrow on (Monday, February 17, 2025) at PM house in, in regard of New CEC of India to be chosen in place of Rajiv Kumar, the outgoing CEC.
The office of LOP has asked the PMO to provide a list of short=listed candidates.
Association of Democratic Reform (ADR) had filed a case against the union of India in regard to the procedural amendment of excluding the CJI as one of the members of the Selection Committee approved by the Supreme of India.
The case is sub-judice and expected to be heard on February 18-19,2025 in the Court of the Hon’ble Justice Surya Kant.
Being cognisant of this fact that matter is sub-judice, the PMO had decided to hold the meeting to take decision in a contentious manner where the LOP had already shown his disagreement and lodged his protest, while giving his LOP reply to the Presidential address in the last Lok Sabha session.
The act of exclusion of CJI from the selection committee for CEC appointment makes, the intent of the present incumbent Government and the spate of allegations faced by the sitting CEC amply evident that they are not inclined to provide a level playing field for free and fair election for the opposition parties either at the state or at federal level. The ruling dispensation wants the domination and complete control of the executive over the institution of CEC like any other government department.
However, as per the protocol if the LOP Rahul Gandhi attends this meeting one can only speculate what might happen? How far one can gauge its consequences if in case he not only attends this meeting in a peaceful and cordial manner but also disagrees with the decision of the majority and records his dissent. Moreover it is interesting to see how the Court will take its stance in case the Union Government finalises the CEC name in its meeting and The highest Court doesn’t give its concurrence.
Are we heading for another Constitutional Crises we will have to wait and see but we wish the good sense shall prevail which doesn’t seem to be there.
